What is Unum’s Disability Claim Handling History?

Unum is the world’s largest disability insurance company and they have had many years in which they publicly reported approximately one billion dollars of “profit”.  Unum has a very shady history. In years past they have been investigated for fraud and unreasonable claim handling by almost every state. Following investigations by the Departments of Insurance from numerous states, the Unum long term disability lawyers could no longer hide the wrongful conduct. Unum finally agreed to a multi-state settlement requiring Unum and the Unum long term disability lawyers to re-evaluate thousands of Unum disability benefit denials. Unum was ordered to pay millions in legal penalties for insurance claims handling violations and was also sued thousands of times for bad-faith long term disability denials.  Unum has also been ordered by several courts to pay punitive damages.

Reviews From Our Clients With Unum Long Term Disability Claims

It’s a priority to achieve the goal of getting your Unum long term disability benefits, but it is equally our goal to do it with a high level of service that earns five-star reviews from our clients.

Glenn P. DMD: Once again my wife Sandy and I cannot thank you enough. If you want to use me as a reference, please feel free. I have been amazed at how confident you have been going up against Unum. I was so worried and anxious after researching their track record. If there is anything I can do to help with potential clients have them call me. If I have any of my fellow dentists that need disability representation, I will send them your way. It has been great working with you and Vanessa.

Sandra D.: My Attorney in NC referred me to your group. Steve has been great! We correspond via e-mail and he answers my questions so quickly. I’m a night owl so I send my emails late at night and by the time I get up he has already emailed me back. He has been so understanding of this hardship and moving as quickly as this stuff allows. His knowledge base has been great and he can break it down to my understanding. Happy Unum is having to pay something and he has got the job done.

Barbara W.: I researched a lot of disability attorneys on-line for an “insurance buy-out” with Unum. I ultimately decided to go with Alex’s firm, I am glad I did, as he was very professional yet down to earth. I literally felt at ease during the entire course of my business with him as well as his staff members. He did everything he said he’d do for me in a quick and timely manner. His fees were within range with other firms based on my research, he always returned my calls and kept me posted from beginning to end. I settled in a few weeks. I don’t think anybody wants to get an attorney to deal with an insurance company, but if you find yourself in this situation as I did, then Dell Disability Lawyers is the way to go! I’m glad I had the opportunity to work with his firm.

Can You Sue UNUM?

Disability insurance attorneys Gregory Dell and Stephen Jessup answer the question: Can You Sue UNUM? Learn what to expect in a group policy lawsuit with UNUM and advantages of suing UNUM with a group policy.

Is Unum a Good Insurance Company?

Attorneys Gregory Dell, Cesar Gavidia, and Stephen Jessup discuss their experience with UNUM’s management of disability income claims. Topics covered include UNUM’s round table reviews of disability claims, UNUM’s “Return To Work” methodology, and the role of your claim rep.

How Do Unum Claimants Review Unum?

As a gigantic company with billions of dollars, Unum may think that they get away with anything and no one knows about. While our lawyers are battling against Unum on a daily basis both in and out of the courtroom, we wanted to create the largest online environment where Unum claimants could review Unum and share their experience. Thousands of claimants visit our website every year to read reviews about Unum and learn as much as they can about Unum. We invite you to read some of the Unum reviews and encourage you to provide a review about your experience with Unum. Below are some reviews from Unum claimants:

Unum terminated my benefits with no warning

K. Potter: I was told I was covered with Unum through my employer (continuum). I got an email today for my termination, no prior talks of infractions with attendance, no warnings, no written warning, straight to termination. I live in Idaho. I have a very well documented medical history of back problems including a herniated disc that is affecting me as we speak and was what prompted me to ask about coverage for things of this nature.

Unum keeps prolonging the process to approve my LTD benefits

Lamecia: I have been waiting for UNUM to make a decision on my long term claim for almost two months. They constantly keep prolonging the process and approve my long term benefits. Instead of requesting my medical records all at one time, they come up with something every week of what they’re needing. I was told a decision would be made within 4-6 weeks. It’s past that time frame I have not received an approval decision. I was recently diagnosed with Spinal Stenosis and cannot perform my regular job duties. I sit for long periods and physical strain on my body will aggrevate the condition per my doctor. I am without any type of income because of this issue. I really need help. I don’t know what to do nor do I understand the process and turn around period for long term disability to be approved.

Everyone gets paid but the one person who needs it most

Douglas J.S.: I recently received a denial from UNUM after receiving 3 payments, who are these people. They told me from the beginning there was no problem with my benefits and then all of a sudden its gone. This is ruining our life the one thing we purchased the insurance to avoid. I had 15 years in my company, 5 years! to go and I loved my job why would I throw that away. They know if they ruin you financially you can’t afford a Lawyer. Everyone gets paid but the one person who needs it most, what a crock.

Unum Disability Questions Answered By Our Lawyers

As part of our continuous effort to share information with Unum disability claimants, we give Unum claimants the opportunity to ask our lawyers general questions and we share the answers so that everyone can benefit. You can search through hundreds of questions that our lawyers have answered, but below are some of the most popular Unum disability questions.

Honey Maria: I have Unum disability insurance and they are asking me to speak with them on the phone before I even submit my application. Do I need to speak with them?

Attorney Steven Dell: If you have not submitted your application as of yet, then it depends if your disability policy requires you to speak with them. If you tell them you have a lawyer assisting you then they will not speak to you unless your lawyer is on the phone. It is usually not a good idea to speak with them as you could say something on a recorded call that could jeopardize your claim. I know that Unum always tries to do a recorded call with an applicant within days of receiving a request for a long term disability application. You should be prepared prior to speaking with Unum and know the implications of everything you say. I am happy to review your disability policy and provide a free phone consultation.

Patrick: Can Unum deny me on the basis of a preexisting condition?

Attorney Stephen Jessup: Patrick, unfortunately, yes. Unlike health insurance, disability insurance policies do contain pre-existing condition limitations. From the dates you have provided it would appear that you fall within the typical pre-existing timelines contained in long term disability insurance policies.

Sayeeda R.: I have received a letter about a filled interview from UNUM. Can I deny it and ask them to send the questions in writing as I have physical difficulty talking for long period of time due to my shortness of breath and facial structure and neuralgia.

Attorney Rachel Alters: Sayeeda, some disability policies require that you participate in a field interview as part of the proof of loss requirement. However, you do not have to have it conducted at your home and may hire an attorney to prepare you and represent you through the field interview. Please contact our office to discuss your options.

Chris: Is it a good idea to get a lump sum from Unum? I am disabled due to a Motor Vehicle Accident. I get disability from the Social security. Also I get a UNUM long term disability check each month. UNUM has asked me have I got my pension check yet. The company I use to work for just offered me it. To either take a lump sum, payment each month, or put it in a IRA. Just wondering what to do so they will not take it all from me. Can they take it all from me? I would like to get the lump sum, but don’t know if that’s a good idea.

Attorney Stephen Jessup: Chris, depending on the policy language if you exercise a lump sum on the pension it would likely be deemed an offset under your policy and they would reduce your benefit by that as well.

What are Examples of Unum Disability Lawsuits?

Unum has been around for more than 50 years and there have been thousands of Unum long term disability lawsuits filed against Unum. Unum long-term disability lawyers defend Unum denials at all costs. Our law firm has battled against Unum in state and federal courts across the United States. Dell Disability Lawyers resolve lawsuit against Unum on behalf of ophthalmologist suffering from bi-lateral carpal tunnel syndrome

Once retained, Dell Disability Lawyers immediately amended the Complaint in order to submit additional allegations which our client’s prior attorney failed to plead. Within approximately two months of being retained, the case was resolved. Read more about this lawsuit against Unum on behalf of our client, an ophthalmologist.

A general surgeon and his legal team at Dell Disability Lawyers win disability insurance jury trial against Unum

This verdict demonstrates that Unum continues to ignore the 2004 agreement it entered into with 48 states, in which its practices for denying claims without reasonable justification were called into question. Read about this lawsuit against Unum on behalf of our client, a surgeon.

General Surgeon wins Long Term Disability Insurance Trial Against Unum

Unum believed that they would win this case at trial because our client had been to the doctor for only 3 visits in a 5 year period to treat his back pain. Our client and his physician explained at trial that additional medical treatment was not necessary and our client testified that he would do daily home exercises.

While our client is no longer able to physically perform the material duties of a general surgeon, his disability policy permits to continue working as a medical doctor and collect his disability benefits. Our client’s trial team included Gregory Dell, Gregory Denes, and Cesar Gavidia.

Read how this general surgeon wins long term disability lawsuit against Unum.

What qualifies as a disability with Unum?

To be considered disabled by Unum, it is necessary for them to determine that you are unable to perform the duties of any occupation you are qualified for, due to the same sickness or injury. Regular care from a physician is also required. In addition, Unum requires that a disability must be expected to last at least 12 months or longer. If these criteria are met, Unum may provide coverage for short-term or long-term disability. However, they may still deny your claim if proper documentation is not provided.

How long will Unum pay long term disability?

The length of payments varies by policy. Certain disability policies provided and managed by UNUM include “lifetime” benefit provisions. These provisions necessitate that a claimant demonstrates their disability onset before the age of 55 (or occasionally 60) and that the disability persists until the age of 65. At this point, the claimant should be eligible for a disability benefit that is paid for the remainder of their life.

Can Unum deny short term disability?

Yes. Without proper documentation Unum may try to deny your claim even with short term disability.

If Unum denies your short term disability claim, it is important to understand why and what steps you can take to appeal their decision. You may be able to submit additional information or request a hearing to present your case.

5 Ways We Help Get Your Benefits Paid

Get Your Disability Application Approved

Our goal is to get your application for disability income benefits approved. Applying for disability benefits can be a difficult process and the information you provide is critical. Most disability insurance companies look at your application in hopes of finding a reason to deny your claim. Your disability company will ask you to complete numerous forms, interview you, request lots of information, speak with your doctors and possibly request to have you examined by their "hired gun" doctor.

Through our experience of having helped thousands of disability insurance claimants, our lawyers will guide you through the entire application process and give you the best chance to get your disability claim approved the first time.

Submit A Strong Appeal Package

If your disability insurance benefits have been wrongfully denied, then our lawyers know exactly what it takes to get your disability claim approved. You only get once chance to submit an Appeal, therefore every piece of evidence that will support your disability claim must be included. The goal is to win your disability benefits at the Appeal level, but while preparing your Appeal you must consider how a federal judge will review your disability claim if your benefit denial is upheld.

Preparing a strong disability appeal package is an art that requires you to understand how the courts interpret your disability policy language, ERISA regulations / laws, and how to strategically present evidence in support of your definition of "disability". We encourage you to contact any of our lawyers for a free immediate review of your disability denial.

Sue Your Disability Company

98% of the disability insurance lawsuits filed by our law firm have resulted in either the payment of benefits or a lump-sum settlement agreement. Our disability lawyers have filed ERISA governed and private policy long term disability insurance lawsuits against every major disability insurance company in state and federal courts nationwide and we love fighting for the "little guy" against the multi-billion dollar insurance company giants.

We have recovered hundreds of millions of dollars for our clients and we would like the opportunity to provide you with a free review of your disability benefit denial. There are many complex factors in a disability benefit lawsuit and the legal battle to win long term disability benefits can be fierce.

Prevent A Disability Benefit Denial

Approval of long-term disability is a continuous process as every disability insurance company will evaluate your eligibility for benefits on a monthly basis. You can never let your guard down and assume that your disability company will continue to pay your benefits for as long as you think you need them.

Our law firm offers a reasonable flat fee monthly claim handling service in which we handle every aspect of your long-term disability claim and do whatever it takes to make sure you are paid every month.

Negotiate a Lump-Sum Settlement

Let's discuss if a lump-sum settlement or buyout of your disability insurance claim is both available and makes financial sense for you. Our lawyers have negotiated more than five-hundred million dollars in disability insurance buyouts and we know how to get you a maximum settlement. A disability insurance company is not required to offer a buyout and not every disability company offers them.

Who do you help?

Our lawyers help individuals that have either purchased a long term disability insurance policy from an insurance company or obtained short or long term disability insurance coverage as a benefit from their employer. We have helped individuals in almost every type of occupation with monthly disability benefit payments ranging from $1,500 to $50,000.

Our clients include all types of employees ranging from retail associates, sales representatives, government employees, police officers, teachers, janitors, nurses, pilots, truck drivers, financial advisors, doctors, dentists, veterinarians, lawyers, consultants, IT professionals, engineers, professional athletes, business owners, and high level executives.

A strong understanding and presentation of the duties of your occupation is essential for securing disability insurance benefits.

Do you work in my state?

Yes. We are a national disability insurance law firm that is available to represent you regardless of where you live in the United States. We have partner lawyers in every state and we have filed lawsuits in most federal courts nationwide. Our disability lawyers represent disability claimants at all stages of a claim for disability insurance benefits. There is nothing that our lawyers have not seen in the disability insurance world.

What are your fees?

Since we represent disability insurance claimants at different stages of a disability insurance claim we offer a variety of different fee options. We understand that claimants living on disability insurance benefits have a limited source of income; therefore we always try to work with the claimant to make our attorney fees as affordable as possible.

The three available fee options are a contingency fee agreement (no attorney fee or cost unless we make a recovery), hourly fee or fixed flat rate.

In every case we provide each client with a written fee agreement detailing the terms and conditions. We always offer a free initial phone consultation and we appreciate the opportunity to work with you in obtaining payment of your disability insurance benefits.

Do I have to come to your office to work with your law firm?

No. For purposes of efficiency and to reduce expenses for our clients we have found that 99% of our clients prefer to communicate via phone, email, fax, GoToMeeting sessions, or Skype. If you prefer an initial in-person meeting please let us know. A disability company will never require you to come to their office and similarly we are set up so that we handle your entire claim without the need for you to come to our office.

How can I contact you?

When you call us during normal business hours you will immediately speak with a disability attorney. We can be reached at 800-698-9159 or by email. Lawyers and staff must return all client calls same day. Client emails are usually replied to within the same business day and seem to be the preferred and most efficient method of communication for most clients.
