Unum keeps prolonging the process to approve my LTD benefits

Lamecia: I have been waiting for UNUM to make a decision on my long term claim for almost two months. They constantly keep prolonging the process and approve my long term benefits. Instead of requesting my medical records all at one time, they come up with something every week of what they’re needing. I was told a decision would be made within 4-6 weeks. It’s past that time frame I have not received an approval decision. I was recently diagnosed with Spinal Stenosis and cannot perform my regular job duties. I sit for long periods and physical strain on my body will aggrevate the condition per my doctor. I am without any type of income because of this issue. I really need help. I don’t know what to do nor do I understand the process and turn around period for long term disability to be approved.

Everyone gets paid but the one person who needs it most

They told me from the beginning there was no problem with my benefits and then all of a sudden its gone. This is ruining our life the one thing we purchased the insurance to avoid. Honey Maria: I have Unum disability insurance and they are asking me to speak with them on the phone before I even submit my application. Do I need to speak with them?

Attorney Steven Dell: If you have not submitted your application as of yet, then it depends if your disability policy requires you to speak with them. If you tell them you have a lawyer assisting you then they will not speak to you unless your lawyer is on the phone. It is usually not a good idea to speak with them as you could say something on a recorded call that could jeopardize your claim. I know that Unum always tries to do a recorded call with an applicant within days of receiving a request for a long term disability application. You should be prepared prior to speaking with Unum and know the implications of everything you say. I am happy to review your disability policy and provide a free phone consultation.


Patrick: Can Unum deny me on the basis of a preexisting condition?

Attorney Stephen Jessup: Patrick, unfortunately, yes. Unlike health insurance, disability insurance policies do contain pre-existing condition limitations. From the dates you have provided it would appear that you fall within the typical pre-existing timelines contained in long term disability insurance policies.


Sayeeda R.: I have received a letter about a filled interview from UNUM. Can I deny it and ask them to send the questions in writing as I have physical difficulty talking for long period of time due to my shortness of breath and facial structure and neuralgia.

Attorney Rachel Alters: Sayeeda, some disability policies require that you participate in a field interview as part of the proof of loss requirement. However, you do not have to have it conducted at your home and may hire an attorney to prepare you and represent you through the field interview. Please contact our office to discuss your options.


Chris: Is it a good idea to get a lump sum from Unum? I am disabled due to a Motor Vehicle Accident. I get disability from the Social security. Also I get a UNUM long term disability check each month. UNUM has asked me have I got my pension check yet. The company I use to work for just offered me it. To either take a lump sum, payment each month, or put it in a IRA. Just wondering what to do so they will not take it all from me. Can they take it all from me? I would like to get the lump sum, but don’t know if that’s a good idea.

Attorney Stephen Jessup: Chris, depending on the policy language if you exercise a lump sum on the pension it would likely be deemed an offset under your policy and they would reduce your benefit by that as well.

General Surgeon wins Long Term Disability Insurance Trial Against Unum

Unum believed that they would win this case at trial because our client had been to the doctor for only 3 visits in a 5 year period to treat his back pain. Our client and his physician explained at trial that additional medical treatment was not necessary and our client testified that he would do daily home exercises.

While our client is no longer able to physically perform the material duties of a general surgeon, his disability policy permits to continue working as a medical doctor and collect his disability benefits. Our client’s trial team included Gregory Dell, Gregory Denes, and Cesar Gavidia.

What qualifies as a disability with Unum?

To be considered disabled by Unum, it is necessary for them to determine that you are unable to perform the duties of any occupation you are qualified for, due to the same sickness or injury. Regular care from a physician is also required. In addition, Unum requires that a disability must be expected to last at least 12 months or longer. If these criteria are met, Unum may provide coverage for short-term or long-term disability. However, they may still deny your claim if proper documentation is not provided.

How long will Unum pay long term disability?

The length of payments varies by policy. Certain disability policies provided and managed by UNUM include “lifetime” benefit provisions. These provisions necessitate that a claimant demonstrates their disability onset before the age of 55 (or occasionally 60) and that the disability persists until the age of 65. At this point, the claimant should be eligible for a disability benefit that is paid for the remainder of their life.

Can Unum deny short term disability?

Yes. Without proper documentation Unum may try to deny your claim even with short term disability.

If Unum denies your short term disability claim, it is important to understand why and what steps you can take to appeal their decision. You may be able to submit additional information or request a hearing to present your case.
