Navigating the Unum Disability Appeal: A Strategic Approach
For anyone facing a Unum disability insurance denial, the road ahead may seem daunting. The rigorous process of appealing a denial requires both strategic planning and a deep understanding of the complexities involved. At its core, each denial has its unique circumstances tied to specific personal conditions, professional duties, and the particulars of the insurance policy. Yet, despite these differences, a structured plan can greatly enhance the chances of a successful appeal.
Gregory Dell, managing lawyer of Dell Disability Lawyers, emphasizes the necessity of acquiring the right documents before embarking on an appeal journey. “We need the policy and the denial letter before we can really give an idea of what we can do,” he says. This preparation allows an attorney to assess the breadth of the case accurately, laying the groundwork for a robust appeal.
Unum’s reputation precedes itself; it is the largest long-term disability insurance company globally. Their sheer volume of claims necessitates standardized methods for evaluating applications and appeals, which can sometimes lead to impersonal and hasty decisions. As Dell notes, “They try to streamline a process because they have so many claims handling people… Every time we get one, it’s basically we know how to attack it.”
An appeal is not simply a rebuttal to a denial. Instead, it involves meticulously compiling and presenting evidence that unequivocally demonstrates an inability to work due to a disability. The goal is not to focus on Unum’s past mistakes but to win the decision on the undeniable facts. With a thorough grasp of the intricate appeal process and the right legal guidance, claimants can transform their initial despair into optimism and, ultimately, a successful appeal.
Understanding the Claims Process
Before delving into how to conquer a Unum disability appeal, it’s crucial to understand the claim process’s framework. Recognizing that each claim is inherently unique is essential. “Every case is so individual to the condition, the occupation… So there might be overarching themes that we may want to look for,” says Stephen Jessup, a partner at Dell Disability Lawyers. This uniqueness means that claimants must present their situations in context.
Ensuring that you have strong medical support is a critical first step. A solid foundation of documented evidence from healthcare professionals can be more persuasive than personal anecdotes of distress. “Unfortunately, we see there’s not always the best doctor support,” says Jessup, highlighting a pervasive issue seen in many claims.
Navigating the Claim File
A vital element often overlooked is the claim file. This file contains everything relevant to your disability insurance claim, from internal correspondence to doctors’ opinions. It’s crucial for constructing a meaningful appeal. In Jessup’s words, getting this file allows the legal team to “dissect and figure out… how can we address these problems to show the support for the disability?”
The transparency offered by the claim file helps identify any gaps or inconsistencies in documentation previously submitted. It’s not uncommon for a claim file to reveal missing records or overlooked details that can be pivotal for your appeal. Moreover, understanding the inner communications and criticisms noted by Unum’s team can give insight into their reasoning, thus enabling strategic responses.
The Importance of Detailed Documentation
A robust appeal is built on detailed documentation. When Unum questions the validity of a claim, they often cite “lack of evidence” as the basis for denials. Hence, compiling documentation that counters this is essential.
Start by focusing on these steps:
Gather Objective Medical Evidence: Objective data, like test results and scans, often hold the most weight in evaluations.
Ensure Comprehensive Doctor Support: Regular, thorough updates from your healthcare providers can strengthen the case against any denials rooted in scant documentation.
Clarify Employment Obligations: Accurately outline job responsibilities, highlighting why these cannot be fulfilled given your condition.
Strategies for a Successful Appeal
A focused strategy is imperative when approaching a Unum disability appeal. The complexity arises not only from your individual claim but also from understanding the methods and regulations Unum employs to process these claims. This section outlines strategic actions you can undertake to enhance your appeal.
Collecting the Right Evidence
It’s important to think like the medical reviewers at Unum. This involves gathering comprehensive evidence that directly contradicts any basis for the denial. “I like to work backwards,” Dell mentions, emphasizing the importance of highlighting objective findings.
When appealing, consider this:
Functional Capacity Evaluations: These tests objectively assess your physical and mental capabilities, providing reliable data.
Vocational Assessments: They establish a clear link between your physical restrictions and your occupational duties.
Expert Opinions and Research: Gather statements from industry experts or academic studies corroborating your condition’s effects on your daily functioning and work capacity.
Dell suggests that it’s about proving, beyond doubt, that the condition significantly hinders your job’s essential duties.
Understanding and Addressing Unum’s Processes
Unum employs routine processes for evaluations, including a “roundtable” meeting strategy. This involves various representatives and experts convening to review claims collectively. Dell describes it as “confirmation bias,” since these discussions often lean towards denying support for claims rather than adequately weighing the claimant’s evidence.
Unum’s practices necessitate a careful approach when crafting your appeal. Assume that any loophole or ambiguity will be scrutinized. Anticipate their counterarguments and directly address any points raised in the denial letter.
Crafting a Persuasive Appeal
The art of writing an appeal lies not just in presenting evidence but in strategically structuring information. As Dell points out, it isn’t about highlighting every mistake. Instead, it’s about focusing on factual elements that showcase the incapability of performing job duties.
Writing with Purpose
When structuring your appeal, remember to:
Convey Convincing Evidence: Present information in a way that leaves minimal room for differing interpretations.
Prioritize Clarity: Ensure that whoever reviews the appeal can follow your argument without confusion.
Maintain Legal Considerations: Balance enough disclosure with the necessary retention of potential legal arguments.
Preventing Future Roadblocks
In some cases, even a successful appeal may inadvertently lead to future limits, especially regarding policy terms like the “24-month limitation for mental health.” Being aware of these can guide advantageous presentation strategies. Use evidence that transcends short-term symptoms to focus on long-term incapabilities or systemic issues instead.
Overcoming Emotional and Psychological Hurdles
Facing a disability insurance denial can be emotionally taxing. It often feels as though the system is working against you. Remember that engaging with the appeal is part of the journey to secure what rightfully belongs to you.
Keeping Perspective
Jessup encourages claimants to “not take it personal.” Emphasizing that denials are not reflections of personal failures but rather results of procedural assessments can help mitigate emotional strain.
By reframing the appeal process as a strategic opportunity rather than a personal affront, claimants can maintain optimism and motivate themselves to pursue their rights diligently.
Empowering Yourself
Statistically, claims tend to be won by remaining persistent and informed about the process. Successful claimants typically share these traits:
Resilience: Continuing to pursue the appeal despite initial setbacks greatly increases chances of success.
Resourcefulness: Being proactive in gathering documentation and responding to requests can expedite resolution.
Patience: Allowing the necessary time for documentation compilation and appeals escalations ensures comprehensive submissions.
Concluding Thoughts
Ultimately, winning a Unum disability appeal requires patience, meticulous planning, and strategic execution. By following a clear, focused approach, and keeping informed, claimants can successfully challenge denials.
Gregory Dell aptly encapsulates this journey: “If you follow our plan, we can get you there.” With a mix of determination and the right guidance, facing a giant like Unum transforms from an overwhelming challenge into a strategic battle where success is entirely possible.
Remember, “it’s not just about your ability to go work at Burger King and flip burgers.” Your unique professional skills and the merits of your case deserve acknowledgment and persistence. A well-structured appeal reclaims the narrative, placing the focus on your rights, capabilities, and potential for success.

I was not able to work as a physician for about 14 months due to neck/back issues. Even though I had 3 medical doctors explicitly state that I was not to work AT ALL as a physician at that time, New York Life (NYL) Disability Insurance denied my long term disability claim (which apparently they deny a high percentage of people similar to me- only they know why they do this to so many- I have my own suspicions). I was in pain from my medical issues and so frustrated with NYL considering I had many bills coming due. I then decided to call Dell Disability Lawyers. One of their attorneys, Alex Palamara, spoke to me on the phone right then to hear and understand my story and then offer ways he could help. Long story short, within a few months of me returning back to work, he was able to persuade NYL to pay me my long term disability claim. He (and his kind assistant, Tabitha) were always very helpful, informative, and available to me. I feel quite certain that NYL would NEVER have paid me what was appropriate based on my insurance agreement/ contract with them without the help of Alex. I highly recommend him/Dell Disability Lawyers. If you find yourself in a similar situation of disability insurance denial of your own personal/group policy, especially if you are a medical provider/physician like me, then consider contacting them for advice/direction PRIOR to appealing your claim on your own.

Jay Symonds and his assistant, Sonia helped me tremendously. The insurance company that worked for my former employer did everything they could to make my life literally miserable. That all changed when I hired Jay. He and Sonia fought for my rights and forced the insurance company to pay what they should have.
If you have a disability claim hire Jay as if you go it alone the insurance company will screw you. Jay and Sonia will fight for everything you are entitled for. I couldn’t recommend them more highly.

I cannot say enough positive things about my experience with Dell Disability Lawyers. Attorney Stephen Jessup and Amanda offered an opportunity to provide clarity on a complex issue regarding my disability claim. Mr. Jessup offered advice on an offset to my claim after my insurance company asked for additional information from Social Security. With counsel from Mr. Jessup, I was able to address the outstanding issue with the Social Security office and provide my insurance company with the required documentation to address their concerns. Mr. Jessup always responded in a timely manner with expert advice and offered the opportunity for follow up. I strongly recommend Dell Disability Lawyers to those seeking legal counsel for disability matters.

9 years ago when I had to apply for disability benefits from my private disability policy the insurance company ignored my inquiries until Dell and Schaefer represented me and I have received the benefits without interruption til my policy expired at age 65. I have appreciated not having to deal directly with the insurance company and having attorney Greg Dell and assistant Danielle Lauria handle all communications which included monthly progress reports. I thank them for their efforts on my behalf and highly recommend them to all those in need of disability benefits.

Our goal is to get your application for disability insurance benefits approved. Applying for disability insurance benefits can be a difficult process and the information you provide is critical. Most disability insurance companies look at your application in hopes of finding a reason to deny your claim. Through our experience of having helped thousands of disability insurance claimants, our disability insurance lawyers will guide you through the entire application process and give you the best chance to get your disability claim approved the first time.
If your disability insurance benefits have been wrongfully denied, then our disability insurance lawyers know exactly what it takes to get your disability claim approved. Yes. We are a national disability insurance law firm that is available to represent you regardless of where you live in the United States. We have partner lawyers in every state and we have filed lawsuits in most federal courts nationwide. Our disability insurance lawyers represent disability claimants at all stages of a claim for disability insurance benefits. There is nothing that our lawyers have not seen in the disability insurance world.
What are your fees?
Since we represent disability insurance claimants at different stages of a disability insurance claim we offer a variety of different fee options. We understand that claimants living on disability insurance benefits have a limited source of income; therefore we always try to work with the claimant to make our attorney fees as affordable as possible.
The three available fee options are a contingency fee agreement (no attorney fee or cost unless we make a recovery), hourly fee or fixed flat rate.
In every case we provide each client with a written fee agreement detailing the terms and conditions. We always offer a free initial phone consultation and we appreciate the opportunity to work with you in obtaining payment of your disability insurance benefits.
Do I have to come to your office to work with your law firm?
No. For purposes of efficiency and to reduce expenses for our clients we have found that 99% of our clients prefer to communicate via phone, email, fax, or video conferencing sessions. If you prefer an initial in-person meeting please let us know. A disability company will never require you to come to their office and similarly we are set up so that we handle your entire claim without the need for you to come to our office.
How can I contact you?
When you call us during normal business hours you will immediately speak with a disability insurance attorney. We can be reached at 800-698-9159 or by email. Lawyers and staff must return all client calls same day. Client emails are usually replied to within the same business day and seem to be the preferred and most efficient method of communication for most clients.
