Question

Is UNUM obligated to pay my children SSI amount with COLA increase to me after they turn 18 or the original award amount?

I was permanently disabled at age 37 from a stroke. My wife was pregnant and I had a 17 month old. My children got benefits until they turned 18 from Social Security and now UNUM is saying I will not get the amount that Social Security has increased in the last 18 years but the amount from 2006. That is a loss of $6000 per year from my original benefit that I would have gotten had I I not had children. Is this legal?

Once the SSDI benefits for your minor children stop then Unum should be responsible to continue paying you the offset amount.
