Unum Approves LTD Claim for Ophthalmologist with Rheumatoid Arthritis

Our client, a 58 year old ophthalmologist, was forced to stop working as a result of rheumatoid arthritis and cervical herniations in his neck. Prior to filing for disability, Dell Disability Lawyers was retained in order to assist with the application for long-term disability benefits and the transition from working full-time to total disability. Our client’s policy stated that he would be considered total disabled if he is “unable to perform the substantial and material duties of his occupation”.

Our client’s pre-disability occupational duties required him to be able to perform eyes surgeries on a weekly basis such as:

  1. Intraocular & extraocular microscopic procedures
  2. Refractive Surgery
  3. Laser keratomilleusis/ (cornea reshaping)
  4. Cataract extraction (Phacoemulsification)
  5. Intraocular lens implantation
  6. Excision of tumors and lesions
  7. Yag Laser Capsulotomy and Iridotomy
  8. Pterygium Removal
  9. Argon laser trabeculoplasty
  10. Chalazion Excision
  11. Insertion of Lacrimal Perm Plugs
  12. Excision of conjunctiva
  13. Phorefractive Keratectomy
  14. Eye lid surgeries

Our client has both an individual disability policy and business overhead policy issued by Unum Provident Corporation. Our client’s disability benefits were paid timely upon completion of the policy’s elimination period. Our law firm continues to manage our client’s disability claim on a monthly basis in order to insure the continuance of benefits in a timely manner.
