Anesthesiologist Approved for Long Term Disability Benfits Plus an Extra 9 Months of Benefits
Our client, an Anesthesiologist, suffered a fall at his home which resulted in rupturing his left quadriceps tendon requiring him to undergo surgery the following day. For the next month and a half, he underwent extensive recovery and rehab in his attempt to return to work. Believing he had sufficiently recovered; he made a return to work on a reduced schedule but within five days knew he was not ready physically to return and had to go back out on leave for another three weeks. Ultimately, a little over three months from his initial injury our client was able to return to work on a half time schedule.
He was able to maintain the halt time duties and continued to work several months and unfortunately slipped and reinjured his left leg. Despite the pain and discomfort, he continued to work for another month before undergoing an MRI, which confirmed he had re-torn his quadriceps tendon. Not wanting to go out of work again he continued to work half time for several more months until the increasing pain, swelling, discomfort and fatigue got to a level that he was not only risking his own well being but more importantly, the safety of his patients. His only option was to file for disability under his policies.
Prior to filing his claims for disability with his insurance companies he contacted Dell Disability Attorneys and spoke with Stephen Jessup. Our client had intended to file his disability claims with a date of disability that corresponded with his last day worked, but Attorney Jessup advised our client after reviewing the policies that he believed the date of disability could be established back to the time of the initial injury, approximately ten months earlier. It was Attorney Jessup’s review and understanding of the policy language and presentation of our client’s claim that resulting in him being able to secure an additional nine months of benefits for the client.
When filing a claim for disability with multiple insurance carriers it is very important to understand the interplay between the policies and how one can best use the policy language to maximize potential benefits for the client. All of our client’s insurance carriers are requesting ongoing claim information and it was the work done in the application stage to make sure a cohesive presentation of our clients claim that took into account the unique language in each policy that has set our client’s claims up for ongoing success and approval.
