Will Mass Mutual pay my disability claim if I become disabled while on unemployment?

My husband's company closed at the end of October 2023. He was a superintendent for a commercial roofing company, and was employed at the same company for almost 38 years. His income was roughly $110K. He was receiving unemployment for several months. In January 2024 our family physician ordered a brain MRI as a result of his memory loss symptoms that have been getting worse over the past year or 2. The MRI showed moderate brain parenchymal volume loss, which is an indicator of dementia. He was referred to a neurologist in March 2024. She confirmed dementia and likely Alzheimer's and advised us to file for disability. She also referred us to a cognitive neurologist who confirmed the diagnosis. My husband is under the care of both neurologists. We've had the MM disability policy for over 20 years due to roofing. We've never filed a claim It does cover mental disabilities. We have an appt on May 2nd with SS to file a SS disability claim. I want to make sure I file the MM claim truthfully, but the form does not allow me to do so because it doesn't take into consideration that my husband was unemployed, but currently looking for work until his diagnosis. Legally, must he be employed at the time of disability for MM to pay our claim, which is $2000/month for 24 months max? I am writing this on behalf of my husband. I have a durable POA to represent him.

Your husband has a complicated fact pattern and you should call us to discuss the claim. You may still be able to file the Mass Mutual claim and they may consider the occupation he last worked in. We have handled claims with a similar fact pattern.
