Question

Why does Northwestern ask the questions they do in the "Request for Continuation of Disability Benefits" form?

Asked on August 5th 2019 by Daniel
While on claim, I receive from NWM an occasional “Request for Continuation of Disability Benefits” form to fill out, sign and send back to them by a certain date. The form asks various questions. One is asking about the details of the disability condition(s) which prevents me from working, one asks what the daily activities that I participate in outside of work, one asks if I am in business for which I have ownership or if said business is in bankruptcy, another asks about any other disability benefits which I receive or have applied for since my last “Request for Continuation of Disability Benefits, another asks if since my last “Request for Continuation of Disability Benefits if I have been outside the US for any reason, and if so, what dates was I outside the US and what countries did I travel to. I am confused by these questions and the reason for them. I understand that this data needs to be collected periodically. I would just like to know if you can offer me an explanation for the questions, why they are asked, etc… I have not been nor do I intend to travel outside the US, but why do they ask?

Daniel, disability insurers ask these questions in order to obtain information relating to your level of activity. NWM can say you’ve traveled to Europe and S. America on vacation this year therefore we believe that based on your travel activity you can go back to work in your occupation. Also, some policies contain foreign residency limitations which limit the period a disability insurer must pay you benefits if you reside more than a specific amount of time outside of the U.S. Your policy may contain this type of provision. For the same purpose they will ask about your engagement in other business activity or ownership. They will reason that if you are able to own another business or engage in other business activity then you could work in your former occupation. As for the bankruptcy question, if you file for bankruptcy and fail to declare your disability insurance benefits and policy as a form of income or potential income then the disability insurer can claim that you are judicially estopped from seeking disability benefits under the policy even if you had dutifully paid premiums for years.
