What qualifies as a disability in Colorado?

Under Colorado disability law, a person is deemed to be disabled if they are unable to engage in their regular or customary work activities due to a physical or mental impairment that has lasted, or is expected to last, 12 months or more. In addition, the disability must be severe enough to prevent the claimant from engaging in any gainful occupation for which they are reasonably suited based on their education and experience.

In order to qualify for disability benefits, a claimant must provide substantial medical evidence that establishes their inability to work. This usually includes detailed information regarding the diagnosis, prognosis, current symptoms and treatments, as well as opinions from medical experts.

What is the appeal process for disability benefits?

After your initial application is denied, you may request a reconsideration of your application. During the reconsideration stage, another review of your application will determine whether it should be approved. If you receive a second denial, you can request a hearing. You have 60 days from the date of the reconsideration’s denial to request a hearing. You will also need to submit any new evidence within 10 days of filing the hearing request.

At the hearing, a judge from the Office of Disability Adjudication and Review (ODAR) will hear your case. Your attorney or legal representative can present evidence, question witnesses, and make arguments on your behalf. The judge may also review documents such as medical records or employment history. After hearing all of the evidence, the judge will issue a decision in writing.

If you are still not satisfied with the judge’s decision, you may appeal the ruling to the Appeals Council. The Appeals Council will review your case and make a final determination on whether or not you qualify for disability benefits.

Do I have to file my disability denial lawsuit in Colorado?

Northwestern Mutual Approves Claim For Disability Benefits — The client, a sole proprietor of a lawn care business, had an eye injury that caused vision problems, leading to the closure of his business. In January 2017, he filed a disability claim with Northwestern Mutual. There were misunderstandings and miscommunication which complicated the process. Northwestern Mutual considered the client to have two jobs – lawn care and rental property management. However, Attorney Stephen Jessup argued that the client only had one job, with rental income being passive. Northwestern Mutual disagreed, citing the client’s claim forms. Attorney Jessup argued for partial disability benefits based on the policy’s provision.

After two years and the involvement of Attorney Jessup, Northwestern eventually approved partial and total disability benefits, retroactive to January 2017.

Cigna Overturns Denial of LTD Benefits to Computer Systems Engineer after Appeal and Independent Medical Examination — A Computer Systems Engineer applied for Long Term Disability (LTD) benefits but was denied by Cigna insurance company. The claimant hired Attorney Alexander Palamara, who reviewed medical and policy records. Attorney Palamara appealed the denial and pointed out inconsistencies in Cigna’s conclusions and their failure to conduct an Independent Medical Examination (IME). Cigna reversed the denial after the IME and approved all pending benefits. The claimant is still receiving support from Attorney Palamara to maintain their claim status.

Attorney Jay Symonds successfully appealed UNUM’s denial of long term disability benefits for a Colorado plumber — Attorney Jay Symonds appealed the denial of long-term disability benefits for Mr. B, a Colorado Plumber. Mr. B stopped working in January 2016 due to medical conditions. He initially claimed short-term disability benefits, which were extended to long-term disability. However, UNUM, the administrator and funder of the benefits, denied the claim. UNUM argued that Mr. B no longer met the policy’s disability definition because he wasn’t under a physician’s care when he stopped working. Cigna overturns Short Term Disability Denial and awards Long Term Disability Benefits — An ex-employee at Critigen, Inc. had her Short Term Disability claim denied by Cigna, despite her health issues. Attorney Alexander Palamara intervened and proved the denial wrong. He demanded approval for both STD and LTD benefits. Cigna reconsidered and approved both benefits.
