Question

Is it true that Hartford cannot use my stepchildren's SSDI payments as an offset?

Asked on August 13th 2017 by Mary HB
I am permanently disabled. I receive both SSDI and the Hartford disability benefits. I have two stepsons who are also permanently disabled and receive monthly SSDI from my monthly social security earnings statements. The Hartford has been using their SSDI payments as an offset. This results in a reduction of nearly $1,000 per month from my disability income. One stepson is 20 (an adult) and one is 17 (a minor soon to be an adult). I just read in the comments that the Hartford canNOT deduct SSDI benefits if the child is disabled. Is this still true and what can I do? The Hartford has been reducing my disability income due to my stepsons SSDI income for over 2 years.

Mary HB, if a dependent is receiving a DSSDI benefit on account of your disability then it would be an offset. If a dependent is receiving a benefit in his or her own name based on their disability the it wouldn’t qualify as a source of Other Income commonly found in employer provided group disability policies.
