Workers comp settlement - will Hartford consider that an offset and stop benefits?

Individual Aetna LTD through employer. I paid all premiums. I received workers' comp settlement, put into non taxable annuity. Do I have to include that in questionnaire and will Hartford consider that an offset and stop benefits? They already have offset on my partial PERA disability benefit.

I was hurt at work, denied workers comp, fought for 3 years and had to wait additional 2 years to get money. I was getting LTD benefits through a plan through my work but an individual policy that I paid all premiums. I finally settled with workers' comp. The company was very upset that I won the case so they still messed me around for about 2 years and we had to fight tooth and nail to get anything from them. I have been getting LTD since 2018 and partial PERA since then. I was getting workers comp from about 2021 until settlement which included paying for my caregivers. I am paraplegic bilateral amputee with many other issues. Settlement from workers' comp went into annuity that I get each month. I am worried I have to claim that and that my LTD now with Hartford will be taken away. I do not get social security until I turn retirement age. I am currently 60. My wife had to quit her job to take care of me so we lost that income which was substantial. Thank you.

Unfortunately, Hartford's group policy does take offsets for a lot of other income you receive. However, it's difficult to determine whether they would take an offset for your individual Aetna policy. You would need to review the other income section in the Hartford policy to see whether that would be an offset. If you need assistance with figuring that out you could email me your policy.
