Question

After 3 months my LTD approval, insurance company stopped LTD payment during review of continuity and also have argument with insurance company regarding offset of my son's disabled adult child benefits

Dear Sir and madam,
I live in PA and has a problem with LTD insurance company, not sure whether your firm can execute lawsuit in PA? Here is the details about my situation. My LTD was approved in October 2023, predating my own disability. My son has been receiving SSI benefits since he turned 18. Upon the approval of my SSDI, my son became eligible for DAC (disabled adult child) benefits. I applied for DAC on behalf of my son in November 2023, and the approval was granted in January 2024. The new DAC benefits will replace SSI starting in February 2024. The insurance company believes my son's DAC benefits result from my disability, but I disagree. I believe DAC benefits are not subject to an offset from LTD because a disabled adult child receives Social Security Disability benefits based on the child's own disability. And you know what happens? Hartford immediately reviews my LTD and stops making payments. I need your help and may file a lawsuit to fight for my rights.
Thanks.

Thank you for contacting us about a Hartford LTD denial. It sounds like there should not be a setoff due to your child’s qualifying SSDI disability. You need to file an appeal before you can file any lawsuit. If you contact us we can review your claim.
