Question
SSDI Backpay and LTD Reimbursement: What New York Life Can and Can't Claim?
I signed the form that said I would pay back any back pay back to them. I don't have a copy of my benefit plan so I'm not sure what it all entails. They had called before I got disability through social security and offered a lump sum payment to me. I never returned their call thinking they were probably trying to pay less somehow. Do I have to pay them back? If I do is there a fee for my tax advocate that was on my case that they can't claim out of the back payment?
Is there usually a length of time they x cap out on ltd payments? I worked for Target Distribution union and they will make up 300. Month of my income. My lump sum from SSDI was 9.589.
Answer
The payment of retroactive SSDI benefits likely created and overpayment that you would be required to pay back. The fee for your SSDI attorney will be deducted from your retroactive award and paid directly by SSA. The LTD carrier will credit you the amount of the SSDI attorney fee. LTD benefits are typically paid to Age65, Age67 or normal Social Security Retirement Age, the Policy will tell you which of the 3 applies to your claim.
