Question

Do I have to sign agreement to pay back difference in LTD payment and SSDI payment?

Asked on November 10th 2023 by huffy
I anticipate transitioning from short term to long term disability with New York Life soon. I think I saw where they get a third party at no charge to me to help get SSDI. I have a bad shoulder and tremors, etc. from Parkinson's which greatly interferes with my job as an ICU RN. I'm thinking about getting legal help if I can afford it.

You do not need to sign the agreement to pay back SSDI. Disability companies try to make you do this and you are not required to sign the form unless the policy state you must. The disability has the right to offset your LTD payment by the amount of your SSDI. NY LIFE is concerned about their ability to collect SSDI overpayment which is why they are asking you to sign this agreement. You can refuse, but they may decide to estimate your SSDI and deduct it from your LTD payment. We can assist you to navigate your claim if you would like help.
