Question

Can I lose my Hartford benefits if I also receive an annuity payment?

Asked on January 8th 2019 by Fred
I have been receiving LTD from the Harford for 6 years after my disability I cound no longer work so retired. As a teacher in Texas I do not qualify for SS, but have been getting my retirement annuity the last 5 years recently the Hartford contacted me to apply for disability from the Teacher Retirement. However I was told by TRS that being that I was already receiving a retirement annuity that I was not eligible for disability benefits from TRS. Am I in Jepordy of losing the LTD from the Hartford being that I am receiving an annuity payment?

Fred, I am happy to hear that your claim is being paid. From the scenario you provided, I don’t believe you are in jeopardy of having your LTD benefit being denied. There is a possibility that your retirement annuity payment might be an “offset” to your LTD claim, so there is a possibility that Hartford will get to pay you less and you may owe them an overpayment for past benefits they paid in full. We need to review a copy of your LTD policy to see if your retirement annuity would be considered an “offset” to your LTD claim. If you can get a copy of your policy, please feel free to contact us for a free consultation.
