I have NO money coming in. I'm so frustrated I could cry.

I had a double lumbar fusion on December 11, 2015 I had a full hysterectomy in 2013 and another back surgery during the summer of 2014. Then, in September of 2015 I began falling due to the problems in my back impacting the nerves in my left leg. I was trying to keep working and postpone the surgery until this coming summer. However, by December 4, I’d had 18 falls. I was literally bruised from head to toe. I worked with UNUM as I have disability insurance with them through my employer. I provided them with all the dates of my employment including when I worked, when I stopped working, when I ran out of paid time, etc. My last paid day was December 2. At the first of January I received a check for 60 percent of my salary from UNUM. I continued to receive those benefits. I was supposed to return to work on 3/17. However, I was still wiped out. The doctor said this was because I was compromised prior to the surgery because of the falls, having multiple big surgeries in a short span of time, etc. I worked two full days and then got a note from the doctor explaining that I would need to be working half days only. I let UNUM know this right away on March 22. It took them weeks to tell me they were denying my claim because they didn’t understand from my doctor’s notes on March 21 why I couldn’t work full days. It took weeks to resolve this and my doctor got involved. They finally told me last week they are approving my disability and are reopening my claim. They asked me to send them pay stubs so they could see how much I am making. (They had this information from last fall.) I sent them pay stubs from December through April. They then saw that I got paid in December what was essentially a regular check. This was because the cut off for the pay period was December 5 – and prior to that date, I had only missed two days unpaid. They now say I should not have been paid for December because I got the money from my employer so NOW they want to make me pay that money back by taking it away from any half -time disability payments I should be getting now. I was docked 100 percent for every single day from December 5 through March 16. I am receiving $42 per month from my employer because they say they can only dock so many days per pay period so I’m still being docked days that I missed prior to March 16. I have NO money coming in. Disability won’t pay and my half-time pay from the school is being eaten up by the docking of past missed days. I am so frustrated I could cry. We do not have $10 right now.

Staci, please feel free to contact our office with a copy of the letter from Unum asserting the overpayment and a copy of your policy to see if they are properly applying the term provisions.
