Unum

I couldn't force Unim to pay up because they strategically kept me in limbo, never denying my claim

UNUM would neither approve or deny my claim, so I could not contest them denying the claim- forcing them to pay up. In Sep 2014 I worked for a company who used UNUM as their long & short-term disability. In Sep 2015 my company let me go, because they could. However, during the Sep to Sep year, UNUM kept asking for different information, including a statement from a doctor I didn’t even see or use when I was off work. It was long-term disability, but I went back to work (with another company) in June 2016. The reason I was on disability was from moderate to severe chrons. They ended up taking most of my intestines and put in a permanent ileostomy bag. I am in Michigan and any attorney I spoke with here said they couldn’t (wouldn’t) do anything because UNUM never denied the claim. They just kept asking for more information until I was too exhausted knowing they never had any plans to pay the claim. Given the dates is there any recourse allowed to go after UNUM? I would be more than happy to join a Class Action Lawsuit against them as well.

William, unfortunately, since Unum never denied your claim and you no longer work for the company there is no recourse. If you still worked there you could file a new claim for your current disability. If your original claim was denied you would have been given 180 days to appeal the decision. If the appeal was not overturned you would have the right to sue Unum. Since you never received a determination and never appealed, you have no legal right to sue.
