Do I have to allow Unum access to my SSA file?

I have recently received another letter from UNUM requesting SSA form 831. I have been receiving long term disability since 2008. The pay back amount is about to be payed off approximately $14,000. Do I have to give UNUM access to SSA? In the past I have not signed the permission form allowing them to have access. However since my son is graduating high school in the same month the pay back amount is complete. SSA will reduce the amount I receive should/will UNUM pick up the difference? The amount awarded from unum in 2008 was $2,000 monthly and I am currently receiving $2,400 from SSA. Will I have to give UNUM access to SSA to confirm the change or will a letter from SSA be sufficient? A minimum amount of $191 has been deducted monthly to pay back the overpayment. I had cancer in 2008 and have chronic pain which I am seeing Doctors on a monthly basis. I am not sure that UNUM’s access to SSA is a good idea!

David, There is most likely no policy language that contains a contractual obligation to allow Unum to access your SSA file at will. If your son will no longer be receiving DSSDI associated with your SSDI, then Unum will have to cease offsetting your benefit by same – effectively picking up that portion of the benefit again. As for COLA increases to your SSDI – typically insurance companies have no right to increases to “other income” benefits based on COLA. The policy will most likely indicate this. It may be possible that Unum would consider a lump sum buyout of your policy. If you are interested, please feel free to contact our office to discuss same.
