Question

I am now concerned if I am not able to return to work after 6 months Unum will stop paying me.

I am receiving STD (for 3 weeks now) from UNUM now with no issues, I recently had left shoulder arthroscopy Labral repair, Distal Clavical Excision, Liited Debridement, and Subacromial Decompression surgery. As of now UNUM has been paying me but I am now concerned if I am not able to return to work after 6 months they will stop paying me, is this something I should be concerned about? Also, after 3 months FMLA ends and worried that I will no longer be protected.

I am currently a HVAC Engineer/Plumber and my position has no light duty designation, so I would need to be 100% in order to return to work. I live in New Jersey but work in New York.

Unum will review your medical records and likely focus on the progress of your surgery recovery. It is important that you inform and talk to your doctor regarding the extent of any pain, discomfort, and ongoing limitations you continue to experience following your surgery. Unum will evaluate the records and forms submitted by you and your doctors to determine if the documentation supports the restrictions and limitations claimed. As an HVAC Engineer/Plumber, your occupation is physically demanding and requires unrestricted use of your arms and shoulders. If your medical records and doctors support that you continue to have limited function, Unum should approve your long-term disability claim.

I was not able to work as a physician for about 14 months due to neck/back issues. Even though I had 3 medical doctors explicitly state that I was not to work AT ALL as a physician at that time, New York Life (NYL) Disability Insurance denied my long term disability claim (which apparently they deny a high percentage of people similar to me- only they know why they do this to so many- I have my own suspicions). I was in pain from my medical issues and so frustrated with NYL considering I had many bills coming due. I then decided to call Dell Disability Lawyers. One of their attorneys, Alex Palamara, spoke to me on the phone right then to hear and understand my story and then offer ways he could help. Long story short, within a few months of me returning back to work, he was able to persuade NYL to pay me my long term disability claim.
