Can I sue Unum for financial stress and emotional stress?

My partner has been trying to get paid by Unum and they been giving her the runaround. I am only a part time employee and can't get more then 30ish hours on average a week. They keep wanting paperwork that we already sent in/or paperwork that FMLA does NOT do. And now at the point where I'm worried we will lose our apartment soon. She hasn't gotten paid in 4 weeks or more.

I am sorry to hear about the issues you and your partner have been going through. Unfortunately, if the policy is an employer provided plan it would be governed by Federal Law- The Employee Retirement Income Security Act (ERISA), and ERISA does not allow for legal action due to pain and suffering or any other damages.
