Question

Long Term Disability with Hartford - They are Stopping my Disability Benefits

Asked on September 20th 2023 by Betty
I have been on a Long-Term Disability benefit with Hartford for over 3 years now. I have had 5 Claim handlers since I have been dealing with Hartford. I found out today that they are stopping my disability benefits. I was in shock and really don't know what to do. I went into the website to check my payment that I get on the 20th of every month from Hartford. I do this because they have stopped my payment three times over the last 3 years. Mainly telling me they have not received something they have needed from me or one of my doctors. When I went into the website it said claim closed and I was surprised since this is what happened in the past when they have stopped my benefits. They have stopped my benefit before stating they did not received what they need from me or my doctors. Many times, they have received it, and they don't reinstate my benefit, so I don't get my payment. Because of this happening in the past, I always go into the website. I then called my claim handler to find out why my disability claim was closed out. When I called of course I got her voicemail and I left a message.

I have had numerous issues with them calling me back most of the time when I leave a message, I don't get a call back. After leaving my claims representative (Stephanie Ellis) a message I thought if she does not call me back, I will not get my benefit and I won't be able to pay my bills. About two months ago I got approved for Social Security Disability and I received a lump sum from SSDI, and I knew i had to pay this back to Hartford for an offset. Hartford sent me what i need to pay them for the offset and I didn't agree with the amount, so I appealed it of course they disagreed and sent me that my appeal was denied, and the letter gave me options on what to do next. One of them is to contact an attorney which I planned on doing. Just got this letter last week stating the appeal was denied.

Anyway, when I called back to find out why my claim says closed on the website, I spoke to Shanayra and she said let me see what I can tell you on your claim from what I can see on the computer system. She tells me that my claim is only good until September 12th and then it will be closed out. She said on the 20th of September in two days I will get a partial benefit for payment from September 1st to the 12th. I said how can that be and what is the reason? She tells me that from what she can see the Hartford is saying based on my policy that I should be able to return to work maybe not the same occupation but back to work. She then said did your claim handler call and tell you ab out this? I was very surprised because no one has called or let me know that this is the case. I have had no notification of any kind that something was being evaluated on my claim. I spoke to my claim representative about 2 months ago and she called me to introduce herself as my new claim representative. Like I said the 5th claim representative I have had. She said that I have nothing to worry about on my claim, but she needed to set up a doctor evaluation for me and I will hear from someone when that will be.

I then received a call and had an evaluation scheduled about two weeks later. When I spoke to the lady at Hartford today, she said that she sees a letter in their system dated August 30th that has not yet been completed and sent to me yet. So why would a letter dated August 30th not have been completed and has not been sent and it is the 18th of September today. All of this is a shock and a huge surprise to me. I need these funds to pay my bills. I can't believe they can do this. Stop your benefit and give you no notification and are working on a letter that is dated August 30th over 19 days ago. I have no idea what to do right now I have had 3 doctors state I am disabled and filled out their lengthy disability forms in fact I know one was completed about 4 months ago by my primary physician. They want documentation basically every couple of months and it is nonstop with them. I can't work and how they can send me a letter that I have been approved for long term disability a while ago.

Now they are stopping my benefits after I am arguing with them on what needs to be paid back to them from my over payment from Social Security. Also had their evaluation they required me to do over a month ago cause this outcome. So now I should all of sudden be denied for disability and be able to go back to work. This is unbelievable I have jumped through so many of their ridiculous hoops just to have this happen. It took me over 2 years to get approved through Social Security for my disability and that just happened two months ago. My disability is memory issues as well as sone stomach issues. I was diagnosed with Brest Cancer or the second time in April of 2020 and I was told since this was my second time having breast cancer, I needed a full mastectomy. After the surgery I got a very bad staph infection and was in and out of the hospital for over 3 months to get the infection under control. I had to have a pick line put in and get home health care. I did have different chemo drugs this second time for treatment, so I had some different side effects.

I am having difficulties with my memory that is my major disability. Sometimes I can't remember what happened the day before. I have no idea if the chemo caused this or maybe the staph infection or Covid. I did have covid while I was going through my treatments. I was in and out of the ER and the hospital during the most critical time of covid. I am very frustrated since my only income will be SSDI if I can't get my income from Hartford, and I cannot pay my bills on that amount. I don't want to have to sell my house but if they cut off my benefits, I may not have a choice. I can't understand how they can do this with no notification whatsoever. I was told everything was good when I spoke to my claim handler about 2 months ago. Then I found out when I called today that there was some review by their Medical Case Management that stopped my benefit. She could not even give me a reason she said what she is seeing on her end is very vague. I have no idea what I should do with that. Very shocked to find out like this and have no idea what the reason is that they are all of sudden denying my disability benefit. Need some help.

5 Ways We Help Get Your Benefits Paid

Get Your Disability Application Approved

Our goal is to get your application for disability income benefits approved. Applying for disability benefits can be a difficult process and the information you provide is critical. Most disability insurance companies look at your application in hopes of finding a reason to deny your claim. Your disability company will ask you to complete numerous forms, interview you, request lots of information, speak with your doctors and possibly request to have you examined by their "hired gun" doctor.

Through our experience of having helped thousands of disability insurance claimants, our lawyers will guide you through the entire application process and give you the best chance to get your disability claim approved the first time.

Submit A Strong Appeal Package

If your disability insurance benefits have been wrongfully denied, then our lawyers know exactly what it takes to get your disability claim approved. You only get once chance to submit an Appeal, therefore every piece of evidence that will support your disability claim must be included. The goal is to win your disability benefits at the Appeal level, but while preparing your Appeal you must consider how a federal judge will review your disability claim if your benefit denial is upheld.

Preparing a strong disability appeal package is an art that requires you to understand how the courts interpret your disability policy language, ERISA regulations / laws, and how to strategically present evidence in support of your definition of "disability". We encourage you to contact any of our lawyers for a free immediate review of your disability denial.

Sue Your Disability Company

98% of the disability insurance lawsuits filed by our law firm have resulted in either the payment of benefits or a lump-sum settlement agreement. Our disability lawyers have filed ERISA governed and private policy long term disability insurance lawsuits against every major disability insurance company in state and federal courts nationwide and we love fighting for the "little guy" against the multi-billion dollar insurance company giants.

We have recovered hundreds of millions of dollars for our clients and we would like the opportunity to provide you with a free review of your disability benefit denial. There are many complex factors in a disability benefit lawsuit and the legal battle to win long term disability benefits can be fierce.

Prevent A Disability Benefit Denial

Approval of long-term disability is a continuous process as every disability insurance company will evaluate your eligibility for benefits on a monthly basis. You can never let your guard down and assume that your disability company will continue to pay your benefits for as long as you think you need them.

Our law firm offers a reasonable flat fee monthly claim handling service in which we handle every aspect of your long-term disability claim and do whatever it takes to make sure you are paid every month.

Negotiate a Lump-Sum Settlement

Let's discuss if a lump-sum settlement or buyout of your disability insurance claim is both available and makes financial sense for you. Our lawyers have negotiated more than five-hundred million dollars in disability insurance buyouts and we know how to get you a maximum settlement. A disability insurance company is not required to offer a buyout and not every disability company offers them.

We have helped individuals in almost every type of occupation with monthly disability benefit payments ranging from $1,500 to $50,000.

Do you work in my state?

Yes. We are a national disability insurance law firm that is available to represent you regardless of where you live in the United States. We have partner lawyers in every state and we have filed lawsuits in most federal courts nationwide. Our disability lawyers represent disability claimants at all stages of a claim for disability insurance benefits. There is nothing that our lawyers have not seen in the disability insurance world.

What are your fees?

Since we represent disability insurance claimants at different stages of a disability insurance claim we offer a variety of different fee options. We understand that claimants living on disability insurance benefits have a limited source of income; therefore we always try to work with the claimant to make our attorney fees as affordable as possible.

The three available fee options are a contingency fee agreement (no attorney fee or cost unless we make a recovery), hourly fee or fixed flat rate.

In every case we provide each client with a written fee agreement detailing the terms and conditions. We always offer a free initial phone consultation and we appreciate the opportunity to work with you in obtaining payment of your disability insurance benefits.

Do I have to come to your office to work with your law firm?

No. For purposes of efficiency and to reduce expenses for our clients we have found that 99% of our clients prefer to communicate via phone, email, fax, GoToMeeting sessions, or Skype. If you prefer an initial in-person meeting please let us know. A disability company will never require you to come to their office and similarly we are set up so that we handle your entire claim without the need for you to come to our office.

How can I contact you?

When you call us during normal business hours you will immediately speak with a disability attorney. We can be reached at 800-698-9159 or by email. Lawyers and staff must return all client calls same day. Client emails are usually replied to within the same business day and seem to be the preferred and most efficient method of communication for most clients.
