Prudential verbally approved my claim and then sent me a denial letter

I have been denied twice from Prudential for my LTD case. Back injury 2009 – knee injury 2011. Back doctor took me out of work (July 2018) due to me working 35 hrs per week and had back pain more as the week went on and issues with my knee so I wasn’t walking properly (stumbling) he was afraid I would fall. I had back surgery 11/2/18 and knee replacement surgery 5/14/19. Prudential denied me twice after the first time telling me they didn’t get the correct paperwork – second time they said they would send my doctors a release form and now I’m waiting for the second denial letter after I asked if they had all the paperwork they needed. Not sure what to do or if I can do anything. The funny thing Prudential reached out to me December 2018 and asked for my information and told me when I would receive my first check, how much it would be for and how long I would receive funds. Then shortly after I received a denial letter. I’m not sure how a doctor who I never met with can assume I can do a job when two doctors that have been treating me for a number of years and after surgeries say I am 75% disabled and unable to do my job? Any information would be appreciated. Thank you.

Jacqueline: Sounds like you have a pretty complex medical situation. And the fact that they verbally approved your claim over the phone then sent a denial letter is unusual. If this is a denial of your appeal (you say it’s a second denial) your next step is most likely to file a lawsuit. If it’s an initial denial you will have the right to submit an appeal. I suggest you contact our office and speak with one of the attorneys to answer any additional specific questions you may have
