Can a disability insurance company deny LTD and/or SSDI disability insurance benefits if a claimant is prescribed medical marijuana by their doctor & obtains a medical marijuana card?

Answer: If your state has legalized medical marijuana then we have never had a client that has had their disability insurance claim challenged due to the use of medical cannabis. If your doctor is prescribing marijuana / cannabis then it would be unreasonable for the disability company to give you a problem.

  • I am on private and SS Disability I take opioids and other nerve medication. I would like to get off all these meds but I need them for extreme small fiber pherphial nueropathy. I would like to ween myself off and try medical marijuana instead. I would do this with the help of my family doctor. I am afraid if I do this my ltd insurance will stop paying me. I am wondering if it would be worth the risk. I would be willing to give you my ltd ins info but not publicly on here my ltd insurance is ruthless.

  • My application for long term disability insurance was denied on the basis of my medial Marijuana card. The company states “people who are prescribed medical Marijuana tend to have more serious conditions than those who are not, so that is our black and white policy” meaning they do not insure anyone who uses medical Marijuana. Is there any legal recourse I can take?
