Question

Do I have to pay back LTD after receiving SSDI?

Asked on September 21st 2023 by Birgit
Hello,
I finally received SSDI after receiving Long Term Disability Insurance for two years. The Standard wants the money back which I received from SSDI as back pay.
I used to work for the local School District, and before for the state. In both organizations, I had LTD with The Standard. Now to my question, do I have to pay the money back to the Standard, after all, I never:
1. received a policy (state and SD)?
2. signed anything?

Almost all school district and state employees who have LTD Insurance do not know that they have to pay the money back. Neither the School District, the state nor the Insurance company discloses this. Could this be a class action claim?

Thank you,
Birgit

Hello. In most group disability policies there is offset language which states you must pay back any LTD that overlaps with a payment for social security disability benefits. You need to review your disability policy.
