Broadspire has denied claim after brain surgery. No one has responded back. What can we do?
3 weeks ago had brain surgery. Thought Broadspire had all the info they needed to pass claim made. They waited 30 days to make contact to let us know she was denied for not sending in paper work. We know for a fact the paper work from doctor was sent. It was sent repeatedly. Now her case worker is no longer responding to messages left on caseworkers answering machine. Need advise as our bills are piling up. This was for short term disability for brain surgery. Any advise would be great.

First, we hope that your wife is recovering. Broadspire acts as a third party administrator for her employer’s disability plan, and as such the ultimate legal responsibility would lie with the employer, so based on what you have said contacting HR could also help to have them look into it. Additionally, if there is a denial of benefits, under the law (ERISA) Broadspire would have to issue a denial letter and explain the right to appeal. However, if it is a matter of paperwork not being received, then I would also look to get the paperwork the doctor sent and also send it directly to make sure it is received.
