Question

Do the new Social Security work history rules make a difference with my any job LTD denial?

Asked on August 5th 2024 by Leo
My insurance company denied my case after 2 years and they said I can do work in another job. They said I had skills from a job I did over 10 years ago. However I was researching online and I saw that social security now only looks at a persons last 5 years of work history and not 15. Will the insurance company consider that rule if I appeal, especially since they reduced my benefit by the SSI I get?

Leo: Private insurance carriers are not required to consider SSA rules/regulations. This does not mean, however, you do not have other arguments to make during an appeal. I suggest you contact our office and speak with one of the attorneys to discuss in more detail your circumstances and your options.
