Question

Short term disability denial

Asked on June 6th 2023 by Herman
My wife had knee replacement surgery on 03-24-2023. Her employer first denied the claim saying she did not enroll in STD, which was incorrect. She has proof that she had coverage beginning October 1st 2022. She then appealed and then they denied the claim because it was a pre existing condition because she had a doctor visit and an injection in the knee in July 2022. Does she have a case to recoup the STD payments that were denied?

Herman:
Pre-existing conditions are the number one reason for disability insurance denials. If the short term disability policy had a preexisting condition limitation then there would be nothing that could be done based upon the facts you presented. I hope your wife has made a good recovery.
