Question

Would I qualify for disability or other program following a planned layoff?

Asked on February 15th 2024 by Robert
I have been employed with my current employer for 3.5 years. Because of worsened medical conditions, I was allowed to work from home for the past several months - our company allows staff to work from home. I was recently notified that I will be laid off effective April 19, 2024. Neither the manager who gave me the news of the layoff nor the company's CEO or HR department would give me a reason as to why I was selected. I asked multiple times. Given that I have had outstanding annual reviews, won a company award for my job performance, and have been successful in my role, I suspect my layoff is a result of my medical condition. It is likely because of my medical conditions I will not be able to find another job in a field in which I have spent the past 35+ years (Information Technology). During the past several months I have experienced declining health including worsening Congestive Heart Failure (dilated cardiomyopathy), Type II Diabetes, Peripheral Neuropathy, and Spinal Stenosis. I am no longer able to stand very long, walk more than 15 - 20 ft at a time, stoop/bend/squat, etc. All basic requirements for my job.

Robert, you can apply for and receive disability benefits under your employer’s group plan prior to your scheduled layoff date. There are many variables so I suggest you contact our office and speak with one of the attorneys to discuss in more detail your circumstances and your options.
