Due to the chronic nature of a condition such as Crohn’s disease, disability carriers will often argue that a claimant has dealt with the condition for years and do not believe it is disabling at this time. Carriers will try to argue that the condition can be controlled with medications and temporary time off from work. Additionally, carriers have argued that while a person has Crohn’s they are actually disabled by a secondary condition of depression or anxiety. A disability carrier will make this argument in order to try to limit long-term disability benefits to a period of 24 months.
